These Terms of Service (“Terms”) govern your use of decostation.ca (the “Site”) and any purchase you make from DecoStation Inc. (“DecoStation,” “we,” “us,” or “our”). By accessing the Site, creating an account, or buying a product, you agree to be bound by these Terms and our Privacy Policy, Refund & Returns Policy, and Shipping & Delivery Policy (collectively, the “Policies”). If you do not accept every part of the Terms, please do not use the Site or our Services.

The most current version of these Terms is always available on this page. We may update them at any time by posting a revised version, and your continued use of the Site after changes are posted constitutes acceptance of those changes.

1. Online Store Terms

  1. Age of majority. You represent that you are at least the age of majority in your province or territory of residence, or that you are the age of majority and have given us consent to allow any minor dependants to use this Site.

  2. Legal use. You may not use our products for any unlawful purpose or violate any Canadian federal, provincial, or local laws— including intellectual-property laws.

  3. Security. You must not transmit worms, viruses, or destructive code. A breach of security will result in immediate termination of Services.

2. General Conditions

  • We reserve the right to refuse service to anyone at any time.

  • Except for credit-card data (which is always encrypted), the content you submit may be transferred unencrypted across networks.

  • You agree not to reproduce, duplicate, sell, or exploit any part of the Service without our written permission.

  • Section headings are for convenience only and do not limit these Terms.

3. Accuracy, Completeness & Timeliness

Information on the Site is provided for general guidance. We are not responsible if material is inaccurate, incomplete, or outdated. Any reliance on the material is at your own risk. Historical content is provided for reference only.

4. Modifications to the Service & Prices

Prices, product descriptions, and Services are subject to change without notice. We may discontinue the Service (or any part of it) at any time without liability.

5. Products & Services

  • Certain items are available exclusively online and may have limited quantities. Returns are governed by our Refund & Returns Policy.

  • We strive to display product colours accurately but cannot guarantee that every monitor will display colours correctly.

  • We may limit sales to any person, region, or jurisdiction and may discontinue products at any time.

  • Prices are shown in Canadian dollars (CAD) unless otherwise stated and exclude applicable taxes.

6. Billing & Account Information

We reserve the right to refuse or cancel any order, limit quantities, or impose conditions on sales. If we change or cancel an order, we will attempt to notify you using the contact information provided at checkout.

You agree to provide current, complete, and accurate purchase and account details so we can fulfil your order and contact you as needed. See our Refund & Returns Policy for more details.

7. Optional Tools & New Features

We may provide access to third-party tools “as-is” without warranties. Use of optional tools or new features is entirely at your own risk and subject to the third party’s terms.

8. Third-Party Links

Third-party links may direct you to websites we do not control. We are not responsible for third-party content or transactions. Review third-party policies before engaging in any transaction.

9. User Comments & Submissions

Any creative ideas, feedback, or other submissions you transmit may be used by us without restriction. You agree that your submissions will not violate any law or third-party rights and will not contain malicious code.

10. Personal Information

The personal data you submit through the Site is governed by our Privacy Policy.

11. Errors, Inaccuracies & Omissions

Occasionally the Site may contain errors or omissions related to products, pricing, or availability. We reserve the right to correct such errors, update information, or cancel orders without prior notice (including after you submit an order).

12. Prohibited Uses

You may not use the Site or its content for any illegal or unauthorised purpose, to violate any laws, to infringe intellectual-property rights, to harass or discriminate, or to upload malicious code. We may terminate your access for violating these prohibitions.

13. Disclaimer of Warranties; Limitation of Liability

The Service and all products are provided “as-is” without any express or implied warranties. To the fullest extent permitted by law, DecoStation and its directors, employees, and suppliers will not be liable for any indirect or consequential damages arising from your use of the Service or products.

Some jurisdictions do not allow certain limitations of liability; in such jurisdictions our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless DecoStation and its affiliates from any claim or demand arising out of your breach of these Terms or violation of any law or third-party rights.

15. Severability

If any provision of these Terms is deemed unlawful or unenforceable, the remainder will remain in full force.

16. Termination

These Terms remain effective until terminated by either party. We may terminate access without notice if we believe you have violated the Terms; you remain liable for outstanding amounts up to the date of termination.

17. Entire Agreement

These Terms, together with the Policies posted on this Site, constitute the entire agreement between you and DecoStation and supersede any prior agreements.

18. Governing Law

These Terms and any related transactions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You irrevocably submit to the exclusive jurisdiction of the courts of Ontario.

19. Changes to Terms

We may update these Terms at any time by posting revisions on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
